Applying for Child Custody After a Divorce

Fill Out Court Forms

You will need to fill up the following court forms before filing a child custody case.

  • Petition for Custody and Support of Minor Children
  • Summons (Uniform Parentage – Petition for Custody and Support)
  • Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act
  • Child Custody and Visitation Application (for visitation schedules, holidays, and other decisions regarding custody)

After answering necessary forms, review them with a divorce lawyer to determine if you missed or would like to add any demands and justifications. Duplicate all forms and keep one for court; make sure to create two more copies for you and your ex-partner.

File Your Paperwork

Submitting paperwork may require a filing fee from the court. Determine this through a court clerk who will officially file your documents in justice. If you cannot afford the fee, you can request a fee waiver through a divorce lawyer in Provo, Utah, or any state you reside.

Right after you accomplish paperwork, ask your attorney to deliver important documents to your ex-partner. Don’t forget to attach a blank copy of the Response to Petition for Custody and Support of Minor Children, and Declaration Under Child Custody Jurisdiction and Enforcement Act forms, as he or she will need to answer these.

Submit Your Proof of Service

The last step in applying for a child custody case is the filing of a Proof of Service of Summons form in court. It is important that you submit this properly because this will formally open your custody case. Once the case is open, a number of hearings that will require you, your child, and ex-partner will come through.
